Welcome to 7th Drive. By accessing or using our website and services, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully.
1.1 This Agreement is made and entered into by and between 7thDrive Pty Ltd (the “Company”) and the person or legal entity hiring the vehicle (the “Hirer”).
1.2 By executing the rental agreement, making payment, or otherwise taking possession or control of the vehicle, the Hirer acknowledges that they have read, understood, and agree to be legally bound by all terms and conditions contained herein.
1.3 This Agreement constitutes a legally binding contract governing the use, hire, and return of the vehicle.
2.1 The Hirer must be at least 25 years of age.
2.2 The Hirer must hold a valid, unrestricted Australian driver licence. For drivers holding a foreign driver licence, a valid International Driving Permit (IDP) must also be presented. Use of international licences and IDPs is subject to prior written approval by 7thDrive Pty Ltd.
2.3 Learner or provisional licences shall not be accepted.
2.4 Any additional drivers must be declared and authorised in writing prior to the commencement of the hire period.
3.1 The vehicle shall only be operated by persons expressly listed and authorised in the rental agreement.
3.2 The vehicle must not be driven under the influence of alcohol, drugs, or any other substances that may impair driving ability.
3.3 The vehicle must not be taken outside the State of Queensland without prior written consent from 7thDrive Pty Ltd.
3.4 The vehicle must not be driven off-road, on beaches, through water crossings, or on any unsealed roads, unless authorised in writing.
3.5 The vehicle must not be used for commercial services, including rideshare, courier, or freight, unless expressly authorised by 7thDrive Pty Ltd.
3.6 The vehicle must not be used in any illegal, reckless, or negligent manner, including the transportation of illegal substances or unauthorised passengers.
3.7 You and any authorised driver must not allow the vehicle to be used for any illegal purpose, race, contest, performance test of any kind, or track racing.
3.8 You must not allow the vehicle to be used to tow or push any object unless expressly authorised in writing by 7thDrive Pty Ltd.
3.9 The vehicle must not be overloaded beyond its manufacturer’s specified seating or weight capacity.
4.1 A daily limit of 150 kilometres applies to each hire period.
4.2 Any kilometres travelled in excess of the daily allowance will be charged at a rate of $2.50 per kilometre.
4.3 Kilometres will be measured using the vehicle’s odometer readings at the start and end of the hire period.
5.1 Smoking or vaping within any vehicle is strictly prohibited. Any breach of this clause will result in a cleaning and deodorisation fee ranging from $500.00 to $1,000.00 depending on severity. The Hirer agrees this represents a genuine pre-estimate of the cost to restore the vehicle to an acceptable condition.
5.2 Pets are strictly prohibited in all vehicles. Breach of this clause will result in a minimum cleaning and deodorisation fee of $300, with the Hirer further liable for any repair or deodorisation expenses required to return the vehicle to a hygienic standard.
5.3 7thDrive Pty Ltd reserves the right to enforce these provisions in full, including by deducting any applicable fees from the Hirer’s security bond or charging their nominated payment method.
6.1 A joint inspection of the vehicle will be conducted at the commencement of the hire period.
6.2 The Hirer is required to examine the vehicle upon collection and report any pre-existing damage immediately.
6.3 Failure to report unlisted damage may result in the Hirer being held liable.
6.4 The vehicle must be returned in substantially the same condition as when provided, subject to fair wear and tear.
7.1 The Hirer and all authorised drivers must operate the vehicle in a safe, lawful, and courteous manner at all times.
7.2 The Hirer must not engage in conduct that endangers passengers, damages the vehicle, or harms the reputation of 7thDrive Pty Ltd.
7.3 All applicable traffic laws and signage must be followed throughout the hire period.
7.4 If the driver’s licence of the Hirer or any authorised driver is suspended, cancelled, disqualified, or otherwise rendered invalid during the hire period, this must be reported to 7thDrive Pty Ltd immediately. Continuing to operate the vehicle under such circumstances is strictly prohibited and may result in immediate termination of the hire agreement.
7.5 You must not, and must ensure that any authorised driver does not, tamper with, disable, interfere with, or attempt to alter any telematics device, GPS unit, or monitoring system installed in the vehicle by 7thDrive Pty Ltd. Any such conduct will constitute a serious breach of this Agreement and may result in termination of hire, forfeiture of the bond, and possible legal action.
8.1 The hire period commences and ends at the times specified in the rental agreement.
8.2 Late returns will incur a charge of $50.00 per hour, capped at the daily hire rate.
8.3 Vehicles returned more than 24 hours late without notification may be reported to the police as stolen.
9.1 All vehicles are provided with a full tank of fuel at the time of hire.
9.2 Vehicles returned with less than a full tank will be charged $3.50 per litre plus a $50.00 refuelling administration fee.
10.1 In the event of a breakdown, accident, or damage, the Hirer must:
(a) Notify 7thDrive Pty Ltd immediately;
(b) Do not admit liability;
(c) Complete an incident report form within 24 hours;
(d) Contact emergency services if required.
10.2 Non-mechanical call-outs (e.g., flat battery, keys locked in vehicle, fuel delivery, tyre change) incur a $350.00 call-out fee.
10.3 Roadside assistance is included only for mechanical failures.
10.4 If a warning light or fault message appears on the vehicle’s dashboard display at any time during the hire period, the Hirer must notify 7thDrive Pty Ltd without delay. Failure to report such issues may result in the Hirer being held responsible for any resulting mechanical damage or safety risks.
10.5 If you or any authorised driver are involved in an accident, or if the vehicle is stolen or subject to attempted theft, you must notify 7thDrive Pty Ltd immediately and provide a written report within two (2) hours of the incident occurring. Failure to report such events promptly may result in full liability for any damage or loss incurred and may affect insurance coverage.
11.1 Comprehensive insurance is included with each hire, subject to an excess equal to the security bond amount applicable to the selected vehicle.
11.2 The Hirer remains fully liable for all loss or damage caused by:
(a) Driving under the influence of drugs or alcohol;
(b) Use of the vehicle by unauthorised persons;
(c) Use of incorrect fuel;
(d) Damage from water, underbody impact, or overhead structures;
(e) Loss, damage, or lock-in of vehicle keys.
11.3 A $150.00 administration fee applies to all damage claims, regardless of insurance coverage.
12.1 The Hirer is responsible for all traffic, toll, parking, and similar fines incurred during the hire period.
12.2 An administration fee of $50.00 will apply for each infringement processed by 7thDrive Pty Ltd.
13.1 Vehicles must be returned in a clean, tidy condition free from waste, odour, or spills.
13.2 If the vehicle is returned in an unacceptable condition, a cleaning fee of $300.00 may apply.
14.1 All cancellations, regardless of notice period, are eligible for a full refund.
14.2 No cancellation fees or administrative charges apply.
14.3 Early return of the vehicle does not entitle the Hirer to a refund for any unused days.
14.4 Gift vouchers are refundable upon request unless they have been redeemed in full or in part.
15.1 A refundable security bond is required before vehicle collection. The bond amount is subject to the vehicle selected and will be confirmed at the time of booking.
15.2 A pre-authorisation hold may be placed on the Hirer’s card and released within 1 to 3 business days after return, subject to a satisfactory inspection and no outstanding fees.
15.3 The Hirer expressly authorises 7thDrive Pty Ltd to deduct any applicable fees, penalties, or charges arising from the hire period from the security bond or card on file. This includes, but is not limited to, excess kilometres, fuel charges, cleaning fees, damage repairs, fines, and insurance excess.
16.1 Vehicles may be fitted with GPS and surveillance tracking devices for operational and security purposes.
16.2 By proceeding with the hire, the Hirer consents to location tracking for the duration of the hire.
16.3 All personal data will be managed in accordance with the Privacy Act 1988 (Cth) and 7thDrive Pty Ltd’s Privacy Policy.
17.1 7thDrive Pty Ltd shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to:
(a) Natural disasters or severe weather events;
(b) Government restrictions or public emergencies;
(c) Industrial disputes;
(d) Supplier failure or vehicle breakdown.
17.1 7thDrive Pty Ltd shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to:
(a) Natural disasters or severe weather events;
(b) Government restrictions or public emergencies;
(c) Industrial disputes;
(d) Supplier failure or vehicle breakdown.
18.1 7thDrive Pty Ltd reserves the right to refuse a booking or terminate an active hire if:
(a) The Hirer breaches these Terms and Conditions;
(b) False or misleading information is provided;
(c) The Hirer appears intoxicated, aggressive, or unfit to drive;
(d) Misuse or illegal activity is suspected.
19.1 This Agreement is governed by the laws of Queensland, Australia.
19.2 Any disputes will be subject to the exclusive jurisdiction of the Queensland courts.
20.1 By signing the hire agreement, accepting vehicle keys, or making payment, the Hirer confirms that they have read, understood, and agreed to these Terms and Conditions.
20.2 The Hirer accepts full financial and legal responsibility for the vehicle throughout the hire period.
Your personal information will be handled in accordance with our Privacy Policy and in compliance with the Privacy Act 1988 (Cth).
To the extent permitted by law, 7th Drive is not liable for any:
